Digital Millennium Copyright Act (DMCA) Policy

This DMCA Policy (“Policy”) applies to the website DueCourse.legal and any related services, content, or applications operated by DueCourse (“DueCourse,” “we,” “us,” or “our”) (collectively, the “Service”).

We respect the intellectual property rights of others and expect users of the Service to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable law, it is our policy to:

  1. Respond to proper notices of alleged copyright infringement; and

  2. Terminate, in appropriate circumstances, users who are determined to be repeat infringers.

2. Filing a DMCA Takedown Notice (Copyright Owners)

If you believe that material available on or through the Service infringes your copyright, you may submit a written DMCA Takedown Notice to our Designated Agent that includes all of the following information:

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

  2. Identification of the copyrighted work that you claim has been infringed, or, if multiple works on the Service are covered by a single notification, a representative list of such works.

  3. Identification of the material that you claim is infringing (or the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example: specific URLs, screenshots, or clear description of where the content appears on the Service).

  4. Your contact information, such as a mailing address, telephone number, and email address, so that we may contact you.

  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please be aware that, under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material or activity is infringing may be subject to liability.


3. Our Response to Proper DMCA Notices

Upon receipt of a valid DMCA Takedown Notice, we will:

  1. Review the notice for completeness and compliance with DMCA requirements.

  2. Remove or disable access to the allegedly infringing material where appropriate.

  3. Notify the user who posted or uploaded the material that we have removed or disabled access to it due to a copyright complaint.

  4. In appropriate circumstances, record the incident for purposes of our repeat infringer policy.

We may provide a copy of your notice (including your contact information) to the user who posted the content so they understand why it was removed and can respond with a Counter-Notice if appropriate.


4. Filing a DMCA Counter-Notice (Users Who Believe Their Content Was Removed in Error)

If your content has been removed or disabled as a result of a DMCA Takedown Notice and you believe this was a mistake or that you are authorized to use the material, you may submit a DMCA Counter-Notice to our Designated Agent.

Your Counter-Notice must include:

  1. Your physical or electronic signature.

  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (for example: the exact URL or page on DueCourse.legal).

  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which DueCourse may be found), and that you will accept service of process from the person who provided the original DMCA Takedown Notice or their agent.

5. Our Response to Counter-Notices

When we receive a valid Counter-Notice, we may:

  1. Forward a copy of the Counter-Notice to the original complainant; and

  2. Inform the complainant that we may restore the removed material or cease disabling access to it within 10–14 business days, unless we receive notice that the complainant has filed an action seeking a court order to restrain you from engaging in the allegedly infringing activity.

If we do not receive notice of such an action within that time frame, we may, at our discretion, restore the content.


6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, it is our policy to terminate, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

A “repeat infringer” may include a user for whom we receive multiple valid DMCA Takedown Notices regarding content they have uploaded or posted. We reserve the right to:

  • Suspend or terminate accounts;

  • Limit access to certain features; and/or

  • Remove content at any time, with or without notice,

if we determine that such actions are appropriate to protect our platform, community, and the rights of copyright owners.


7. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that:

  • Material or activity is infringing, or

  • Material or activity was removed or disabled by mistake or misidentification,

may be liable for damages, including costs and attorneys’ fees incurred by the alleged infringer, by any copyright owner or their licensee, or by a service provider who is injured by such misrepresentation.

Please do not use this process to harass users or to attempt to remove lawful content. Doing so may expose you to legal and financial consequences.


8. User Responsibilities and Best Practices

By using DueCourse.legal, you agree that:

  • You will only upload, post, or share content for which you have all necessary rights, licenses, or permissions.

  • You are solely responsible for the content you publish and any consequences arising from it.

  • You will respect the intellectual property rights of others and respond promptly if you receive communication from us about a DMCA notice involving your content.

If you have questions about whether your use of content is lawful (for example, under fair use), you should consult with an attorney. DueCourse cannot provide legal advice.


9. Technical Measures

We may cooperate with copyright owners by:

  • Implementing standard technical measures designed to identify or protect copyrighted works; and

  • Taking action when we become aware of content that appears to infringe copyrights.

We reserve the right to update or change these technical measures at any time.


10. Changes to This DMCA Policy

We may update this DMCA Policy from time to time. When we do, we will revise the “Effective Date” at the top of this page. Your continued use of the Service after any changes are posted constitutes your acceptance of those changes.

If you do not agree with this Policy, you should discontinue use of the Service.
